The plan must have existed in 2008 for it to receive contributions from 2008 income.

Sorry for the late reply, but the best thing to do would have been to setup a SEP IRA and max its contributions (although they would normally be lower than the Solo 401k) and then after you setup the Solo 401k you could transfer the SEP funds to the Solo 401k.
